1. CARMOVE GENERAL PRIVACY POLICY

From CARMOVE We want to offer you a safe and reliable browsing experience and service. Therefore, we have implemented this privacy policy, which complies with the security measures required by European Regulation 679/2016 of 27 April, on the protection of natural persons with regard to the processing of personal data (hereinafter, GDPR).

1.1 In which sections of the Platform do we collect your personal data?

a) Through the rental booking form on the Website

On the website, users will find the option to reserve a vehicle. To do so, they must provide their name, surname, email address, age, contact telephone number, and the option to attach a copy of their identity document and driver's license to expedite the reservation process and allow us to contact them. They can also provide any other information we may require and any other details they deem relevant in their message.

b) Through our corporate email

You can write to us via our email: info@carmove.es and/or request any information you deem necessary to clarify any doubts related to our services or the operation of our website.

c) Through social media

We may collect your data through your user profile on the social networks we use from CARMOVE, which are detailed in section 1.9 of this policy.

1.2. What is the objective and/or purpose of collecting this data?

The purpose of collecting data in all the sections mentioned above is to maintain direct and personalized contact with our Users. We will use your data to address your questions or provide the information you have requested, manage your inquiries, and inform you of activities we believe may be of interest to you.

We may also use your data for advertising and marketing purposes, as well as regarding updates to our products if you are/have been a customer, or if you have taken/are taking a free trial of the services offered by CARMOVE.

The email you send us through the booking form and/or the email from which you write to our corporate email and/or that you provided when registering as a user, will be used to send you information related to the questions or concerns you have raised, advice, news and promotions, as appropriate.

Under no circumstances will the User receive information from third parties without having been informed and having their consent requested beforehand, thus ensuring compliance with the parameters of the law.

In any case, if you are not interested in what we send you, you can unsubscribe in the email you receive.

1.3. Use of personal data

CARMOVE informs its Users that the personal data they provide will be processed by CARMOVE in accordance with the provisions of the aforementioned GDPR.

The purpose of processing data through the means established in point 1 will be, in detail, the following:

Please be advised that the information you provide through this website may reveal or allow others to infer your nationality, ethnicity, gender, age, or other aspects of your private life. As stated in the previous points, CARMOVE will not share User data with third parties. Should it wish to do so, Users will be informed beforehand and their consent will be requested.

1.5. Unambiguous consent for the processing of your data

In compliance with the GDPR and in accordance with our internal policies, each time you send us personal data you must give your express and unequivocal consent by clicking on the box that appears at the bottom of each form where your data is collected.

When you write to our contact email address, you are expressly agreeing that we may collect your data for the purpose or request you have made to us.

By taking this action(s), you are freely and unequivocally indicating that you agree that CARMOVE may process your data for the purposes mentioned in the previous sections.

By accepting the platform's terms and conditions at the appropriate time and when your signature is added to a document through our solution, you are freely and knowingly authorizing the processing of your biometric or fingerprint data. This authorizes us to process data considered a special category under the GDPR. This data is encrypted within the document and cannot be used by CARMOVE under any circumstances. The User guarantees that the personal data provided to CARMOVE is truthful and is responsible for notifying CARMOVE of any changes to said data. The User is also responsible for the accuracy of the names and/or email addresses provided to the recipients; CARMOVE is not responsible for non-delivery of these data if there is an error in the information provided or for any other reason attributable to the sending user.

The User's acceptance that their data be processed for the purposes set out in this policy is always revocable, without retroactive effect, in accordance with current legislation.

1.6. Other requirements and particularities

The services, access to content and product offerings on this website are exclusively directed to people over 18 years of age. Therefore, anyone who provides their personal data declares that they are of that age, and the use of CARMOVE and the delivery of personal data by minors is prohibited.

If you do not provide all the data deemed necessary, CARMOVE may, depending on the case, not process your request.

Access	By exercising this right, you can find out what personal data of yours is being processed by CARMOVE; its purpose, origin or possible transfer to third parties.
Rectification	It consists of being able to modify your personal data that is inaccurate or incomplete, specifying in the request which data you wish to be modified.
Cancellation	It allows the cancellation of your personal data because it is inadequate or excessive.

For these purposes, CARMOVE uses a system for transmitting data and documents to the server where they are stored that complies with the measures detailed in letter c).

In addition, CARMOVE informs that, for the service it provides and in order to carry it out with all guarantees, it collects, among others, the following user data: date and time of the signature, action taken (signed or rejected), operating system used, browser used, geolocation data (city), signature status and IP address, and the biometric data of the aforementioned signature (pressure, writing angle, speed, acceleration, letter formation and direction of signature features).

Furthermore, and aware of the importance to the user of the documents they may send, CARMOVE undertakes to inform them of any situation that may have jeopardized the confidentiality and availability of both the aforementioned documents and their data, adopting all measures within its reach as soon as possible to resolve said incident.

However, the aforementioned obligation will not apply when communicating the incident to users could further jeopardize their data or documentation. In any case, the mandatory procedures for notifying the competent authority, when required by law, or the user(s) affected by the potential incident, will be followed.

1. Measures that are applied in detail to the CARMOVE solution:
   • All access to CARMOVE is done through secure connections using an https security certificate.
   • Digital documents archived in CARMOVE will be stored encrypted.
   • The CARMOVE access password will be stored in encrypted form while it is active.
   • To ensure confidentiality, accessibility and availability, the files stored in CARMOVE will be stored on distributed and replicated systems.
2. Personal data provided through the website or during the registration and/or sign-up process for services will be processed by CARMOVE for the purpose of providing the services offered, as well as sending offers of products and services from this company by any means, including email, improving the business relationship and managing requests made by customers, provided that this has been collected individually and expressly, in compliance with the provisions of the aforementioned GDPR.
3. The data collection and user consent procedures are outlined in this document, but the user and/or client should be aware that CARMOVE uses cloud services, meaning its servers are located within the client's designated space. In this case, CARMOVE requested that its servers be located solely and exclusively in Germany.

1. CARMOVE may contract with third parties for the provision of certain services that may involve access to or storage of your data or documents by said third parties. In all these cases, CARMOVE has signed legally required data processing agreements with these third parties, which, among other terms, detail the purpose of accessing the data and the security conditions, as well as the commitments and obligations that CARMOVE acquires.

Notwithstanding the foregoing, as a User of our Website, you understand, accept, and acknowledge that internet security measures are not infallible and that, therefore, you are obligated to adopt the necessary security measures to ensure your confidence in the website where you are entering your data. We will also do everything possible to guarantee the privacy and security of your identification data at all times, always exercising the utmost diligence and implementing the necessary measures.

In accordance with the foregoing, CARMOVE cannot guarantee that unauthorized third parties will not be able to access information regarding the type, conditions, characteristics, and circumstances of Users' use of the services offered on the platform. CARMOVE maintains a corporate profile on the social media platforms Facebook, Twitter, LinkedIn, and Instagram. Therefore, in accordance with Personal Data Protection regulations, CARMOVE is the "Data Controller" of your data due to the existence of these social media profiles and the fact that you follow us and we may follow you.

This means that if you decide to join our corporate profile as a follower or by liking our content or profile, you accept this policy, which explains your rights and how we use your data.

As the data controller, we guarantee confidentiality in the processing of your data and compliance with your rights, always under the effects of the aforementioned regulations.

However, we also inform you that there is no link between CARMOVE and these platforms or social networks, so you will accept their usage policy and conditions once you access them and/or validate their notices, terms and conditions in the registration procedure, CARMOVE is not responsible for the use or processing of your data that is done outside of the strict relationship and provision of services indicated in this policy.

1. PRIVACY POLICY FOR RECIPIENT USERS

2.1. CARMOVE's role as data processor

This type of user is informed that, on the one hand, their data will be stored for the provision of services commissioned by the client or registered user, to send them the documentation or information sent by that client or user through one of CARMOVE's solutions and to be able to verify, depending on the service that they have contracted or indicated, whether you have received the email sent, signed the document, authenticate your identity as well as the date, time and city from where you signed or validated the documents or information received.

As far as this is concerned, your data will not be used for any purpose not contemplated in this policy, committing to store your data ensuring compliance with the security measures required in particular for electronic trust service providers and privacy or data protection established by the applicable laws in force at any given time, with the exception of the processing indicated below.

2.2. CARMOVE's role as data controller

In accordance with this policy, CARMOVE will also be responsible for the data of users who receive information, as this data may be stored and processed to send information about CARMOVE, promotions, or any other information for advertising or marketing purposes that we believe may be of interest to you. In any case, and as previously stated, users may unsubscribe from these emails or information sent to them via the method established in section 1.6, which also applies to this data processing. In any event, you will be fully informed about how to accept all such data processing.

1. PRIVACY POLICY FOR THIRD-PARTY USERS

If, in accordance with the provisions of point i) of section 1.1, the user accesses CARMOVE services on behalf of their service provider, they must comply with the information and privacy policy established in relation to the processing of data carried out by said service provider, and must expressly consent to it where appropriate.

In the case described above, CARMOVE acts as the data processor of your data, therefore your data will not be used for purposes other than those entrusted by said Main Provider, subject to the instructions provided by the latter and complying in all cases with the security measures applicable to said processing under the provisions of the data protection regulations in force at any given time.

CARMOVE does not use cookies, either its own or those of third parties, to monitor and improve certain functionalities and services.
